Have you shipped to the correct address? it's different for Premium and Regular, if you have sent to a wrong address, your cases will be rejected before it goes to lottery/random slection process.

When is the lottery happening?Are the dates disclosed?

USCIS allows first 5 business days from April 01, 2016. This means USCIS should receive all H1B Petitions by April 07, 2016. USCIS will NOT accept H1B petitions after this date if they receive applications covering the H1B Cap. (65,000+20,000 - (Minus) 5,800 for Singapore/Chile)

My h1b was filed under normal process at California,  my employer provided mail tracking and the package reached on April 01. Keeping my fingers crossed!

Hello. My employer filed H1B under Standard Processing. How soon can I upgrade it to Premium Processing? Do I need to wait for the receipt from USCIS before I can upgrade? Is the receipt the same things as I-797C? Will I get the receipt only if I am picked in the lottery? I read somewhere that lottery results keep coming as late as July. Does that mean I can't upgrade to Premium until July?

If your H1B is filed under normal processing, you can only upgrade to premium processing once you get the I-797 H1B receipt notice. If your employer has not filed the H1B yet, you still have time. Please note the lottery results will come before the end of may.

Thank you very much for your prompt reply. Just wanted to clarify that is the I-797 receipt notice sent by USCIS only after a lottery decision is made? If yes then does this imply that I might not hear from USCIS till end of May.

I am currently working full time on OPT which expires in July. I am also filing for OPT extension in case I don't get picked up in lottery (I am a STEM major with MS degree in US). I want to upgrade my H1B application to Premium because I need to travel outside of US in June for 10 days and I was hoping I could get the H1B result before I leave.

I have been told that I might not be able to come back to US if H1B application is still under processing. Any light you can shed on this would be immensely helpful.

The I-797 Receipt notice will only be issued after your case is picked in the lottery. For normal processing cases, you may have to wait until the End of May. If you upgrade your H1B and leave the country and you may have to apply for an H1B Visa at a US Consulate, if a visa is stamped; you can return only on October 01 (or 10 Days earlier than October 01).

Keep in mind, you may also risk losing your job/project as I do not know if the project will wait until October 01.

Traveling back on OPT while H1B is pending is very risky!

If USCIS has approved your OPT you will be expected to have your EAD in hand to re-enter the United States, in addition to your Form I-20, valid passport and visa, and a letter of employment if you have one. If you exceed the limits on unemployment while outside the United States, you will not be eligible to re-enter the United States in F-1 status.

Be Cautious of Travel During H1B Cap-Gap Relief

As explained, travel on OPT requires a valid, unexpired OPT card. Some students have extended permission to work after the expiration of the OPT under what is known as "cap-gap" relief. These students may remain in the United States and benefit from cap gap. However, this option will be lost if they travel outside the United States. They would not be able to return to the U.S. to utilize the remaining F-1 OPT cap-gap time. Students in this situation should consult with a qualified immigration attorney prior to planning any travel abroad.

Multiple H1 from Multiple Employers at different locations to different clients is valid ??

Yes, you can have multiple H1Bs filed for different jobs. USCIS does not require a resume for processing the H1B Petition, I did not understand what you meant by "SAME RESUME ALL OVER"? Please explain!

All the employers should raise with same resume number of years of exp in the resume and the type of job applied for ??

If you are experienced with multiple skills and you have a resume for a particular skill with X number of years for a specific job it's okay.

Otherwise it's not okay to have the same resume with different experience levels!

Yes, it is a random selection process and the results should be out within April.

As said multiple H1's are valid , if that is the case every year there is chance for a candidate two get picked in such case he can opt for only one the other gets voided so the slot gets added in the subsequent years ??

The visa numbers will not carry to next year, if one gets 2 h1bs, someone is losing an opportunity. Unless the second h1b is withdrawn prior to October 01. USCIS is still considering carrying unused/denied visa numbers.

My h1b was filed under regular processing at VT ,  my employer provided Fedex tracking number by email . I have checked that the package reached on April 01. But how can i ensure that this tracking for my petition ?

You have to wait for the Lottery results and an H1B  Receipt Notice. There is no other way to ensure that the Tracking belongs to you.

Somewhere I read that by 11th April USCIS will conduct lottery but employer will get theresult by end of May or first half of June. Is it correct? If yes then why USCIS delay the communication of lottery results from 11th April to May end?

The H1B Random selection process (Lottery) will be concluded prior to April 14. Howevber, only Premium processing cases will get receipts in the Month of April and regular cases will get receipt in the Month of May (Based on last year, subject to change)

Lottery will be concluded by April 16th and USCIS will first send premium processing receipts followed by regular cases.

I got fedex tracking number this morning from Employer , immediately I have checked in online in fedex tracking site , and it says delivered and delivery date is April 7 th 11:48 am , does it mean it reached too late ? Does it been taken by uscis for lottery process ?

My case is similar to the Badol, I have not got receipt yet, but employer orally informed me that my name is picked up in the lottery.  should i have been got receipt by yesterday at any cause? because my employer told it will take 3 weeks, please clarify me.

Hi Dan,

I have received a Request for Evidence (RFE) from USCIS on my H-1B application. Issue presented in RFE is whether my employer will maintain the “Right to Control” the individual’s employment in the US for the duration of the petition.  The RFE is also seeking to verify the contractual relationship between employer and the end-client, as well as the specific activities the employee will be conducting on the project.

My attorney has suggested to provide RoC document along with End Client letter. But problem is I am not working with the same client currently. I moved on to a different project and thus will not be able to obtain End client letter as I don't work for them anymore.

Do I have any other options at this stage?
