Hello Sir, I am in India and had filed H1B through a small Indian employer in 2015 by paying entire money to an Indian Account. He had asked me to provide a signed agreement. Now he is asking for notarized agreement before he give me documents for stamping. I have provided him notarized agreement but I have no faith in him, as I have got to know through my friend that he has created lot of legal troubles to his employees in past. Can I just go ahead and get the stamping done and then try to transfer my H1 and then travel through other employer. Can he create any legal issues in India or US as I hv already provided notarized agreement in which breach of agreement is USD 24000 fine. My H1b is getting expired in 10 months. Though I have the H1 B petition which I hv got through FOIA, but no Indian employer is ready to file H1 transfer for unstamped visa. Agreement lines says: “This agreement is valid upon signing and upon entering united states on valid work authorization document....” Please suggest If I can go ahead and get it stamped snd then transfer without travelling through this employer. Will there be any legal issues or penality which he can force me to bear?
